Two branches of the federal government, the Food and Drug Administration (FDA) and the Federal Trade Commission (FTC) regulate the tanning industry.

The FDA regulates the manufacture and use of tanning equipment, as well as tanning accessories, as defined by the following two acts: the Radiation Control for Health and Safety Act and the Federal Food, Drug, and Cosmetics Act.

The amended performance standard for sunlamp products is defined in 21 CFR 1040.20. The methods used to determine tanning times and the labeling requirements are specified in this document.

The FTC regulates the claims made by participants in the tanning industry. Any questions concerning truth in advertising may be investigated by this agency.
